Media Matters campaign against Limbaugh isn't censorship

I agree that what media matters is doing isn't censorship, but I disagree that the "private v. public" distinction ends the discussion.  to be sure, the distiction is dispositive as a matter of  First Amendment law - but the question of whether something constitutes censorship doesn't end with whether it violates the First Amendment.  To begin with, many states recognize expression rights against private actors, such as when New Jersey's Supreme Court held that shopping malls can't stifle all forms of expression at their whim simply because their replacement of the trandtional public square happens to be privately owned.  And that ultimately illustrates the flaw in so much of libertarian thinking: its more concerned with whether something is "government" than whether something is truly a threat to liberty.  Private authority can be just as stifling and public authority, and while there are clear differences between the enforcement mechanisms, the lines have been blurring as of late.

Nothing scares a limp dick judge like jury nullification - because it people taking their power back

As far as I'm concerned, Daniel Kaminsky is a hero - having saved somebody from the ruin of their life over a victimless crime. And the jurors that turned him in are low class rats. The judge is even lower for failing to recognize that jury nullification has a rich history in our nation and that the jury, at the end of the day, is the consceience of the community. Bravo, Daniel, for having a conscience.

Per  a post on Dying Scene:

 If you’re lucky, the only time you’ve been looking up at bassist Joe Escalante on a raised platform is when you getting crushed in the pit at a Vandals show.  If you’re unlucky, it’s been in small claims court when he declares you guilty for vandalism charges. Escalante currently serves as a temporary judge, presiding over small claims, traffic, unlawful detainment, limited civil, and limited criminal matters.
Escalante now seeks to be a permanent county-paid judge, and to do so must run in an upcoming June 5th election.


While it certainly isn’t commonplace, it’s not absolutely unheard of for a punk musician to run for public office. Jello Biafra of The Dead Kennedys ran for mayor of San Francisco.

There is a huge difference between Jello running for mayor in a campaign that outright mocked the players within the power structure and a clean cut career goals musician doling out the man's "justice" by the book.
